These Terms of Use (“Terms”) apply to sellmycaronline.com, our offer form at my.sellmycaronline.com, and the offers, pickups and purchases arranged through it. Sell My Car Online is a brand of Junk Car Medics LLC (“Sell My Car Online,” “we,” “us” or “our”). By using the site or requesting an offer, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the site.

Who can use the site

To request an offer or sell us a vehicle, you must:

  • be at least 18 years old;
  • be the legal owner of the vehicle, or be authorized by the owner to sell it; and
  • give us information that is true, accurate and complete.

How offers work

  • Your offer is based on what you tell us. We price your car using the details you provide about its condition, mileage, ownership and location.
  • Offers are valid for the period we give you when we make them. After that, we may update the offer.
  • We confirm the details at pickup. If the vehicle is materially different from what you described, for example undisclosed damage, missing parts, different mileage or a title problem, we may revise or withdraw the offer.
  • No obligation. You can decline any offer, including a revised one, at any time before you sign the transfer paperwork, and there’s no charge for declining.
  • We may decline to buy a vehicle, for example if we can’t verify ownership or the vehicle doesn’t meet our requirements.
  • Estimates aren’t guarantees. Any value, range or estimate shown on the site is a guide, not a promise to buy at that price.

Your responsibilities when you sell

  • Describe the vehicle honestly. Tell us about known damage, mechanical problems, and any salvage, rebuilt, flood or similar title history. Give us the vehicle’s VIN and photos that show its condition.
  • Prove ownership. Have a valid title in your name, or the documents that show you have the right to sell, and a government-issued photo ID. The title must be free of any loan or lien: if there is one, it has to be paid off and released before we can buy the vehicle.
  • Sign the paperwork. Sign the title, bill of sale, odometer disclosure and any other documents the law requires.
  • Remove your belongings. Take your personal items out of the vehicle before pickup. We aren’t responsible for items left inside.
  • Handle plates, registration and insurance. Remove your license plates if your state requires it. After the sale, cancel your registration and insurance and file any release of liability your state requires.
  • Only sell what’s yours to sell. You confirm the vehicle isn’t stolen and isn’t subject to any claim you haven’t told us about. If a title or ownership problem comes to light after the sale, you agree to work with us to resolve it.

Pickup and payment

  • Free pickup. We pick up the vehicle at a time and place we agree with you, at no cost to you. You or someone you authorize needs to be there to hand over the keys and sign the paperwork, and the vehicle needs to be reachable by a tow truck or transport vehicle.
  • Payment at pickup. We pay you at pickup once the paperwork is complete, using the payment method we confirm when we schedule your pickup.
  • Transfer of ownership. Ownership of the vehicle, and responsibility for it, passes to us when the transfer paperwork is signed and you’ve been paid.
  • Sale documents. The bill of sale and any other documents you sign at pickup also apply to your sale. If they conflict with these Terms, those documents control for that sale.

Calls, texts and email

By giving us your phone number and agreeing to be contacted, you agree that Sell My Car Online may call and text you about your offer, your pickup and your sale, including with automated technology. We’ll send you marketing messages only with your consent, and agreeing to them is never a condition of selling your car.

Our texts are about your offer, your pickup, your payment and your sale. If you text us first, for example from a “Text us” link on this site, we reply by text to what you asked.

  • Message frequency varies. Message and data rates may apply.
  • Reply STOP to stop texts. Reply HELP for help.

  • Wireless carriers are not liable for delayed or undelivered messages.
  • You confirm that the phone number you give us is yours, or that you’re authorized to use it.

Using the site

You may use the site to learn about selling your car and to request an offer. When you use it, you agree not to:

  • submit false information, or someone else’s vehicle or contact details without their permission;
  • use bots, scrapers or other automated tools to access or copy the site;
  • interfere with the site’s security or operation, or try to access systems you’re not authorized to use;
  • copy, resell or republish the site’s content without our written permission; or
  • use the site for anything unlawful or fraudulent.

Our content

The site’s content, design, logos and the Sell My Car Online name belong to Junk Car Medics LLC or its licensors and are protected by intellectual property laws. You may not use them without our written permission.

Third-party websites and services

The site may link to websites and services run by others. We don’t control them and aren’t responsible for their content or practices.

Disclaimers

The site is provided “as is” and “as available.” To the fullest extent permitted by law, we make no warranties of any kind about the site, including that it will be uninterrupted, error-free or secure. Information on the site, including any guidance about titles, registration or paperwork, is general information and not legal, tax or financial advice. Check your state’s motor vehicle agency for the rules that apply to you.

Limitation of liability

To the fullest extent permitted by law, Junk Car Medics LLC and its members, employees and agents won’t be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the site. Our total liability for any claim relating to the site is limited to $100.

This doesn’t limit our obligation to pay you the agreed price for a vehicle you’ve sold us, or any liability that the law doesn’t allow us to limit.

Indemnity

You agree to indemnify and hold harmless Junk Car Medics LLC and its members, employees and agents from claims, losses and expenses, including reasonable attorneys’ fees, that arise from information you gave us that was false, from a vehicle you didn’t have the right to sell, or from your violation of these Terms.

Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute relating to these Terms, the site or a sale will be resolved in the state or federal courts located in the State of New York, and you consent to their jurisdiction. Either of us may bring a qualifying claim in small claims court instead. Before filing a claim, please contact us so we can try to resolve it informally.

Changes to these Terms

We may update these Terms. When we do, we’ll change the effective date at the top. If you keep using the site after an update, you accept the updated Terms. Changes don’t affect a sale that was already completed.

General

  • If any part of these Terms is found unenforceable, the rest stays in effect.
  • If we don’t enforce a provision right away, we haven’t waived it.
  • These Terms, our Privacy Policy and any documents you sign for a sale are the entire agreement between you and us about the site and your sale.
  • We may transfer our rights and obligations under these Terms as part of a sale, merger or reorganization of our business.
